1 Acceptance of Terms

By downloading, installing, accessing, or using the MotivGo mobile application (the "App"), you agree to be legally bound by these Terms of Use ("Terms"), our Privacy Policy, and any other policies referenced herein.

If you do not agree to these Terms in their entirety, you must not download, install, or use the App.

2 Eligibility

You must meet the following requirements to use MotivGo:

• You must be at least 13 years of age to create an account and use the App.
• If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian.
• You must not be prohibited from receiving services under the laws of your applicable jurisdiction.
• You must provide accurate and truthful information during registration.

By using the App, you represent and warrant that you meet all eligibility requirements listed above.

3 Your Account

When you create an account with MotivGo, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

• You agree to provide accurate, current, and complete information during registration.
• You are solely responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized use of your account.
• MotivGo reserves the right to suspend or terminate accounts that violate these Terms.
• You may not transfer, sell, or share your account with any other person.

4 License to Use

Subject to your compliance with these Terms, MotivGo grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal device solely for your personal, non-commercial purposes.

This license does not include the right to:

• Modify, copy, or create derivative works based on the App or its content.
• Reverse engineer, decompile, or disassemble any part of the App.
• Distribute, sell, sublicense, or commercially exploit the App.
• Use the App for any unlawful, harmful, or fraudulent purpose.
• Remove or alter any proprietary notices, logos, or labels in the App.

This license is automatically revoked if you violate any of these Terms.

5 Prohibited Conduct

When using MotivGo, you agree not to:

• Use the App for any illegal purpose or in violation of any local, state, national, or international law.
• Attempt to gain unauthorized access to any part of the App, its servers, or related systems.
• Introduce viruses, malware, or any other malicious code into the App.
• Scrape, harvest, or collect any data from the App without our express written permission.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the App or its related services.
• Use automated scripts, bots, or other tools to interact with the App.
• Attempt to probe, scan, or test the vulnerability of the App or any related system.

Violation of any of the above may result in immediate termination of your account and potential legal action.

6 Subscriptions & Billing

MotivGo offers both a free tier and a paid Premium subscription. By subscribing to a Premium plan, you agree to the following:

• Billing: Subscription fees are billed on a recurring monthly or annual basis through the Apple App Store or Google Play Store, depending on your device.
• Auto-renewal: Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of your current billing period.
• Refunds: All purchases are subject to the refund policy of the applicable app store. MotivGo does not directly process refunds. Please contact Apple or Google support for refund requests.
• Price changes: We reserve the right to modify our subscription pricing. We will notify you of any price changes in advance.

7 Your Data & Privacy

MotivGo is designed with your privacy as a priority. The majority of your data — including your goals, occurrences, streaks, and settings — is stored locally on your device and never transmitted to our servers without your consent.

• Your goal data, habit history, and personal progress remain on your device.
• We do not sell, rent, or trade your personal information to third parties.
• Limited account information (e.g. email address) may be stored securely to support account management.
• Push notification preferences are managed entirely on your device.
• We may collect anonymized, aggregated usage data to improve the App experience.

Our full data practices are described in our Privacy Policy, which forms part of these Terms.

8 Intellectual Property

All content, features, and functionality of MotivGo — including but not limited to the App's design, graphics, logos, text, motivational content, audio messages, icons, and code — are owned by MotivGo and are protected by applicable copyright, trademark, and intellectual property laws.

• The MotivGo name, logo, and brand identity are the exclusive property of MotivGo.
• You may not use our brand assets without prior written permission.
• All motivational messages and audio content within the App are original works protected by copyright.
• User-generated content (e.g. custom goal titles) remains owned by you, but you grant MotivGo a limited license to display it within the App.

9 Disclaimer of Warranties

MotivGo is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, MotivGo disclaims all warranties including:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the App will be uninterrupted, error-free, or free of viruses.
• Warranties regarding the accuracy, reliability, or completeness of any content in the App.

10 Limitation of Liability

To the maximum extent permitted by applicable law, MotivGo and its team members, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to:

• Your use of or inability to use the App.
• Any unauthorized access to or alteration of your data.
• Any loss of data, profits, or goodwill.
• Any bugs, viruses, or malicious code transmitted through the App.
• Any errors or inaccuracies in the content of the App.

In no event shall MotivGo's total cumulative liability to you exceed the greater of (a) the amount you paid for the App in the twelve months preceding the claim, or (b) $10.00 USD.

11 Termination

We reserve the right to suspend or terminate your access to MotivGo at any time, with or without notice, for any of the following reasons:

• Violation of these Terms of Use or our Privacy Policy.
• Engaging in conduct that is harmful, abusive, or illegal.
• Extended inactivity on your account.
• Discontinuation or significant modification of the App.

You may also terminate your use at any time by deleting the App from your device and cancelling any active subscriptions. Upon termination, your license to use the App immediately ends. Locally stored data will be removed when you uninstall the App.

12 Changes to Terms

MotivGo reserves the right to modify these Terms at any time. When we make material changes, we will notify you by:

• Updating the "Last updated" date at the top of this page.
• Displaying an in-app notification of the updated Terms.
• Sending a notification to the email address associated with your account (if applicable).

Your continued use of the App following any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

13 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising out of or relating to these Terms or your use of MotivGo shall be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the applicable jurisdiction. You waive any right to a jury trial or to participate in a class action lawsuit.
